What's Next for Jakarta? Governor Pramono on Court Ruling

TEMPO.CO, Jakarta - Jakarta Governor Pramono Anung has responded to the Constitutional Court's decision affirming that Jakarta remains the capital city of Indonesia.

Pramono welcomed the ruling, stating that the administrative measures taken by the Jakarta Provincial Government have consistently aligned with Constitutional Court Decision No. 71/PUU-XXIV/2026.

"So, that is why until today, all activities in Jakarta still use the 'DKI' designation until there is a presidential decision to move the capital. Therefore, what has been decided by the Constitutional Court is what we have been implementing all this time," Pramono said in a statement in Jakarta on May 13, 2026.

According to Pramono, as long as there is no legal framework in the form of a presidential decree regarding the relocation, Jakarta will remain the capital of Indonesia. "Indeed, I fully understand and know that as long as there is no presidential decision for the relocation, then the capital remains in DKI Jakarta," he said.

Pramono also emphasized that there will be no significant changes in the bureaucratic governance of the Jakarta Provincial Government following the court's decision. This is because the provincial government continues to position itself as the center of national government.

"Because so far, from the perspective of the Jakarta Provincial Government, Jakarta remains the capital of the country, so we treat it as such. This Constitutional Court decision serves as a reaffirmation of that," Pramono said.

The National Capital Integrated Coastal Development (NCICD) authority respects the constitutional decision-making process at the Constitutional Court as part of the democratic mechanism and the rule of law in the country.

NCICD spokesperson Troy Pantouw stated that the Court's decision on case number 71/PUU-XXIV/2026 is not an issue. "We have no problem," Troy said when confirmed via WhatsApp message on Wednesday, May 13, 2026.

According to him, the Constitutional Court's decision actually reaffirms that the relocation of the national capital from Jakarta to Nusantara will take effect only after the issuance of a Presidential Decree, as mandated by law.

Troy added that the Court's decision would not affect the progress of development within the NCICD. The project will continue according to the stages set by the government.

On May 12, 2026, the Court rejected a petition challenging Law Number 3 of 2022 concerning the Nusantara Capital City (IKN Law). In its consideration, the Court examined the petitioner's arguments and evidence regarding the material testing of Article 39, paragraph (1) of the IKN Law.

According to the Court, Nusantara orIKN has been legally and politically established as the national capital. However, the actual relocation process is still awaiting the president's decision.

Thus, within the bounds of reasonable reasoning, as long as the president's decision regarding the relocation of the national capital from Jakarta to Nusantara has not been established, the capital remains in Jakarta.

Constitutional Judge Adies Kadir considered that the petitioner's argument regarding Article 2, paragraph (1) of Law Number 2 of 2024 was not synchronized with the norm of Article 39, paragraph (1) of the IKN Law. This lack of synchronization caused a perceived vacancy in the status of the national capital, which must be interpreted in relation to the norm of Article 73 of Law Number 2 of 2024.

In Article 73 of Law Number 2 of 2024, Adies stated that the law shall take effect only when the president’s decision regarding the relocation of the national capital from Jakarta to Nusantara is officially established.
