PM-Elect Peter Magyar: Hungary Ready to Arrest Netanyahu if He Visits

TEMPO.CO, Jakarta Prime Minister (PM)-elect of Hungary, Peter Magyar, said on Monday that his country should detain Israeli PM Benjamin Netanyahu if he enters Hungarian territory while being sought by the International Criminal Court (ICC).

The ICC issued an arrest warrant for Netanyahu in November 2024 on charges of war crimes and crimes against humanity in the Gaza genocide. ICC member states are generally obliged to detain individuals subject to such warrants.

Hungary had previously refused to arrest the Israeli leader when he visited Budapest in April 2025. At that time, Netanyahu's loyal ally, Viktor Orbn, was still serving as the prime minister.

Prior to that meeting, Orbn announced Hungary's withdrawal from the ICC, a process that takes one year to come into effect based on the court's statute, and guaranteed legal immunity for Netanyahu.

However, as reported by Politico, Magyar has announced that he will halt the withdrawal from the ICC on June 2. This means a year after Hungary submitted an official notice of withdrawal to the UN secretary-general.

When asked by journalists what this means for Netanyahu's planned visit this autumn - he has received an invitation from Hungary - Magyar said, "I made this clear to the Israeli prime minister as well … it is the Tisza government’s firm intention to stop this (invitation) and ensure that Hungary remains a member of the ICC."

He added: "If a country is a member of the ICC and a person who is wanted by the ICC enters our territory, then that person must be taken into custody."

However, some countries claim that they can remain ICC members without enforcing such warrants.

France argues that arresting Netanyahu would violate other agreements it has with Israel. Article 98 of the ICC statute serves as France's reasoning. The article states that a state cannot "act inconsistently with its obligations under international law with respect to the … diplomatic immunity of a person."

German Chancellor at the time, Olaf Scholz, said in April 2025 that he could not imagine his country arresting Netanyahu. Italy also granted legal immunity to the Israeli leader.
